TERMS AND CONDITIONS
The following guidelines concern the general conditions of sale for all products proposed by ALAIN MILLIAT SAS on its website www.alain-milliat.com. Any order for a product offered for sale on the website www.alain-milliat.com implies acceptance of the following general conditions of sale.
Article 1 – Purpose
The following contract defines the rights and obligations of ALAIN MILLIAT SAS and its customer in connection with the sale of products proposed on the website www.alain-milliat.com. These general conditions establish the entire rights and obligations of ALAIN MILLIAT SAS and its customer in connection with the sale of products proposed on the website www.alain-milliat.com, without any other condition beyond those prescribed by these general conditions. ALAIN MILLIAT SAS reserves the right to modify or alter these terms at any time.
Article 2 – Products
The products proposed on sale comply with current French legislation and standards applicable in France as of the date of purchase. Photographs showing the articles have an indicative value. Prices indicated include VAT but do not include shipping charges. Free shipping can apply, depending on the size and value of your order. This information is available when ordering. Sales prices can change at any time. The customer is aware that his order will be delivered by postal services.
Article 3 - Customer's obligations
The Customer declares be at least 18 years of age and to have the legal capacity or hold parental permission allowing themselves to place an order on the Site. The Customer undertakes to provide ALAIN MILLIAT elements of real and necessary information for the performance of the intended service of the present conditions as requested online and relevant to their situation, including a valid first name, last name, address, phone and email address. The Customer is responsible for any consequences deriving from any false or inaccurate information transmitted in which the return might be unlawful. Once the order has been placed, ALAIN MILLIAT addresses an email to the Customer confirming it. It informs of the sending of the Products. The Customer may modify their personal information under the "My Account" section.
Article 4 – Orders
An order placed on the e-commerce boutique is valid once the customer clicks on « Complete Checkout ». The placing of an order implies the acceptance of these general conditions of sale and is considered as proof of the date the order is placed. The buyer will be notified of his order by electronic mail by ALAIN MILLIAT SAS. ALAIN MILLIAT reserves the right to cancel or refuse an order in case of dispute with the Customer on a previous order. ALAIN MILLIAT can accept orders within the limits of available stocks. It informs the Customer of the availability of products sold on the Site at the time of order confirmation. If, despite the vigilance of ALAIN MILLIAT, products are unavailable, ALAIN MILLIAT will inform the Customer by e-mail as soon as possible. The Customer may then cancel the order and refund, if applicable, the amounts already paid. The permanent or temporary unavailability does not in any way engage the responsibility of ALAIN MILLIAT, nor does it imply any right to compensation or damages in favour of the Client.
Article 5 - Payment
All orders are payable in euros. ALAIN MILLIAT SAS reserves the right to suspend or cancel any order and/or delivery, regardless of its nature and degree of exectution, in the event of non-payment or any other event considered as a fault of the buyer. To proceed to the payment, the buyer has the choice of the following payment options: A INSTRUIRE. For bank card payments, bank accounts are debited at the time the order is placed, to the condition of having obtained prior authorisation with the relevant payment centers, in the absence of which the order will not be taken into account. The payment order may be revoked in case of misuse of the card in accordance with the agreement between the customer and his bank. Prices can be modified at any time without notice and especially in the event of change of tax or economic data. The items will be billed based on rates in effect at the time of registration of the order.
Articles 6 – Withdrawal rights
Every customer who is not satisfied by the products ordered on the e-commerce website is entitled to exercise his right of withdrawal in optimum conditions. In application of article L. 121-20 of the French Consumer Code, the buyer has a period of seven (7) working days within which to return, at his own expense, the product(s) ordered should they fail to give satisfaction. Said time period begins on the day of delivery of the order. The customer has the choice to ask either for the refund of the paid sums (including shipping costs of delivery, but not return) or for the exchange of the product. The product(s) must imperatively be returned in perfect condition for reselling.
Article 7 – Refund policy
In the hypothesis of the exercise of the right of withdrawal, the customer will be refunded within a maximum of thirty (30) days from the day the returned product(s) are delivered to our warehouse. The customer has the choice to ask either for the refund of the paid sums, or for the exchange of the product.
Article 8 – Delivery
ALAIN MILLIAT SAS guarantees to deliver customers orders within a maximum of thirty (30) days from the date of the order. Product(s) is(are) delivered to the address mentioned by the customer on the order form, in mainland France. Invoices are sent by electronic mail to the electronic mail address mentioned by the customer in his account details or when ordering. Any complaint shall be sent in writing to the address mentioned above. In the event of damaged product(s), the customer agrees to report it by mail, together with photographs of the damaged item(s) within three (3) days following the receipt of the order. ALAIN MILLIAT SAS agrees to refund or exchange the damaged item(s), according to the customer's wish. ALAIN MILLIAT SAS does its utmost to meet the delivery date set by the customer when ordering. The delivery date set by the customer is indicative and non binding. Delivery in Metropolitan France is provided by Chronopost, and delivery cost are:
- 9 euros to 14 euros for any order including 1 to 11 products
- free from 80€.
Please note that orders must be prepared before shipped. If an order is placed before 4pm, it will be prepared on the day after and shipped the following day. Orders cannot be prepared nor shipped during weekends and French holidays.
Article 9 – Governing law
The parties agree that all clauses in these present general conditions of sale are governed by French law.
Article 10 – Disputes
In the hypothetical event of a dispute, the parties involved commit themselves to seeking out an amicable solution before resorting to any legal action. Failing amicable agreement, any action at law arising out of or relating to these general conditions of sale shall be brought before the competent courts.
Article 11 - Force majeure
The parties cannot be held responsible of having failed to meet their contractual obligations when the failure to implement the respective obligations was originated by force majeure. It is explicitely agreed that, other than those which are normally accepted by case law of French courts and tribunals, the following shall be considered as cases of force majeure : strike, civil or foreign warfare, riot, declared or undeclared hostilities, partial or complete destruction of production sites or other premises and facilities, manufacturing incidents, transport disturbances, supply difficulties, or any other fortuitous event which either totally or partially delays or prevents ALAIN MILLIAT SAS to fulfill its obligations. The immediate effect of a force majeure event, as described above, will be to suspend execution of the contract ; if the force majeure event lasts more than one (1) month, the customer would then have the right to cancel the pending order, refund then taking place under the conditions given in article 7 of these general conditions of sale.
Article 12 – Partial invalidity
Should any provision of the present general conditions of sale become null and void as a result of a change in legislation, regulations, or by virtue of a court decision, the other provisions of the present general conditions of sale shall remain in full force and effect.
Article 13 – Limitation of liability
ALAIN MILLIAT SAS cannot be held responsible for indirect, special or consequential damages that could arise from the purchased product(s).
Article 14 - Intellectual property
In no case the customer is allowed to download or modify all or part of the Site and its contents (listed products, descriptions, images, videos ...). This Site or any portion of this Site shall in no case be reproduced, copied, sold or exploited for commercial purposes without the express written permission of ALAIN MILLIAT. In general, all copyrights, trademarks and other distinctive signs and property rights or intellectual property appearing on the Site, will remain the full property of ALAIN MILLIAT. The Customer is therefore obliged to respect intellectual property rights and will not in any way use the trademarks appearing on the Site and on the Products in any eventuality, or deposit a trademark that would prejudice the rights of the owner, unless otherwise stated by contract. It is the same for any other right of intellectual property.
